Your Agreement for Luxury Villa Rentals in Koh Samui

These Terms & Conditions ("Terms") govern all villa and property rentals booked through Mr Property Siam ("we", "us", "our"). By making a reservation and/or staying at one of our managed properties, you ("Guest", "you", "your") agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not proceed with the booking.
1. SCOPE OF SERVICES
We act as a property management and rental agency for villas and other accommodations in Koh Samui and surrounding areas.
Your booking may be with us as the manager on behalf of the owner, or directly with the property owner, but in all cases these Terms apply in addition to any property-specific house rules.
2. BOOKING & PAYMENT TERMS
2.1 Rates & Currency
• All rates are per property, per night, unless otherwise stated
• Prices are shown in the currency indicated at the time of booking and on your confirmation
• Rates are subject to change until your booking is confirmed and deposit is received
2.2 Standard Booking Terms (Default)
Deposit:
A 30% non-refundable deposit of the total rental amount is due at the time of reservation.
Balance Payment:
The remaining 70% is due 4 weeks (28 days) before arrival.
Bookings made within 4 weeks of arrival:
For reservations made less than 4 weeks before arrival, 100% of the total rental amount is payable at the time of booking.
2.3 Alternative 50/50 Payment Option (On Request Only)
In specific cases and only on request and approval by us, the following alternative payment schedule may be allowed:
• 50% of the total rental amount at the time of booking
• 50% of the total rental amount on arrival
This option is not guaranteed and may not be available for all properties, dates, or promotions.
2.4 Non-Refundable Rate Option
For some bookings, we offer a non-refundable rate at a discounted price.
Under this option:
• 100% of the total rental amount is charged at the time of booking
• A discount (e.g. 10%) is applied compared to the flexible rate. The exact discount will be stated at the time of booking
• All payments under the non-refundable option are strictly non-refundable, except where required by law
3. CANCELLATION POLICY (STANDARD FLEXIBLE RATE)
The following conditions apply to bookings made under the Standard Booking Terms / Flexible Rate:
Cancellation more than 30 days before arrival:
• Cancellation is free of charge
• Any payments received will be refunded (excluding potential bank/transfer fees)
Cancellation 30 to 15 days before arrival:
• A penalty equal to the first 3 nights of the total booking will be charged
• Any amount paid above this penalty will be refunded
Cancellation less than 15 days before arrival:
• A 50% penalty of the total booking amount applies
• If you have already paid more than 50%, the balance will be refunded
No-show or early departure:
• In case of no arrival without notice, or early departure, the full amount of the confirmed stay is chargeable and non-refundable
4. CANCELLATION POLICY (NON-REFUNDABLE RATE)
For bookings made under the Non-Refundable Rate:
At any time after booking:
• If you cancel, modify, or do not arrive, 100% of the total rental amount is charged, and no refund will be provided
• In special situations (e.g. force majeure, travel restrictions), we may, at our sole discretion, offer a date change or credit rather than a refund, but this is not guaranteed
5. DATE CHANGES, CREDITS & RE-SELLING CANCELLED DATES
We understand that plans can change and we aim to be as helpful as possible while also protecting property owners.
Date changes (Standard Rate):
More than 30 days before arrival:
• Date changes are usually possible subject to availability and any price difference
Within 30 days before arrival:
• Any change is treated as a cancellation and new booking, and the normal cancellation penalties apply, unless we agree otherwise in writing
Attempt to re-sell cancelled dates:
• If you cancel within a penalty period, we will try to re-sell your dates
• If we successfully re-sell all or part of the cancelled stay, we may, at our discretion:
- Provide a partial refund, or
- Offer a credit towards a future stay
• Any refund or credit may be reduced by an administration fee and any discount or promotion used to re-sell the dates
• We cannot guarantee that cancelled dates will be re-sold
• Any exceptions or special arrangements must be confirmed in writing by us
6. SECURITY DEPOSIT & ADDITIONAL CHARGES
A refundable security/damage deposit may be required, either at booking or on arrival. The amount and conditions will be stated in your booking confirmation or house rules.
The deposit is intended to cover, for example:
• Damage to the property or its contents
• Missing items
• Excessive cleaning
• Unpaid extras (e.g. minibars, extra guests, late check-out fees, etc.)
The deposit (or remaining balance after deductions) will be refunded after check-out, once the property has been inspected. Timing of the refund may depend on your bank/payment provider.
You are responsible for any damage or costs exceeding the deposit amount.
7. INCLUDED SERVICES, UTILITIES & EXTRA COSTS
Your booking confirmation will state what is included (e.g. cleaning schedule, breakfast or not, Wi-Fi, etc.).
Electricity & water:
• Some properties include standard electricity consumption; others charge based on meter readings. Such details will be specified in the listing and/or your confirmation
Optional extra services (e.g. private chef, breakfast, airport transfer, car/motorbike rental, tours, massages at the villa) are usually not included and charged separately, as agreed.
Any city taxes, service charges, or government fees not included in the rate will be charged as required by local regulations.
8. CHECK-IN, CHECK-OUT & IDENTIFICATION
• Standard check-in and check-out times are as indicated in your booking confirmation
• Early check-in or late check-out is subject to availability and may incur additional charges
• You must provide valid government-issued identification (passport or national ID card) for all adult guests, in accordance with Thai law
• We may be required to register your stay with local authorities
9. GUEST RESPONSIBILITIES & HOUSE RULES
By staying at the property, you agree to:
• Respect and follow all house rules provided before or at check-in
• Use the property for residential holiday purposes only, not for commercial activities, photo/film shoots, or events without prior written consent
• Not exceed the maximum occupancy stated in the listing/confirmation. Additional guests may be refused or charged extra
• Keep noise to a reasonable level, especially during night hours, respecting neighbours and local community
• Refrain from any illegal activities or behaviour that may cause damage, disturbance, or danger
• Not smoke inside the property where smoking is prohibited. Smoking fines/extra cleaning charges may apply
• Not keep pets at the property unless explicitly allowed in writing
We reserve the right to terminate your stay without refund if you seriously breach these rules or behave in a way that endangers people or property.
10. CHILDREN & SAFETY
• You are fully responsible for the safety and supervision of children at all times
• Many villas have pools, stairs, balconies, and other potential hazards. You must take appropriate care and precautions, especially with young children and non-swimmers
• We and the property owners cannot be held liable for accidents or injuries resulting from lack of supervision or failure to follow safety instructions
11. LIABILITY & DISCLAIMERS
While we take great care in maintaining the properties, you stay at your own risk.
Neither we nor the property owners are responsible for:
• Loss, theft, or damage to your personal belongings
• Any injury, illness, or death occurring during your stay, except where caused by our proven negligence or wilful misconduct
• Failures of public utilities or services (e.g. water, electricity, internet), or noise from neighbouring properties, construction, or events beyond our control
Our total liability in connection with your booking will not exceed the total amount paid by you for the specific stay, unless otherwise required by law.
12. FORCE MAJEURE
We are not liable for any failure or delay in performing our obligations if such failure or delay is caused by events beyond our reasonable control, including but not limited to:
• Natural disasters, severe weather, floods, earthquakes
• Epidemics, pandemics, or public health emergencies
• Acts of war, terrorism, civil unrest
• Government actions, travel restrictions, or changes in law
• Power outages or failures of public infrastructure
In such cases, we may:
• Offer a change of dates
• Provide a credit for a future stay, or
• Apply our standard cancellation policy
Depending on the situation, property owner's decision, and local regulations.
13. CHANGES TO YOUR BOOKING OR TO THE PROPERTY
If, for any reason beyond our control, the property you booked becomes unavailable (e.g. serious maintenance issue, sale of the property, unexpected damage), we will:
• Inform you as soon as possible, and
• Offer a similar alternative property where possible, or
• Provide a refund of amounts paid if no acceptable alternative can be found
We are not responsible for any additional costs or losses you may incur due to such changes (e.g. flights, transport, etc.), beyond the refund of your rental payments.
14. DATA PROTECTION & PRIVACY
• We collect and process your personal data in order to handle your booking, comply with legal obligations, and provide our services
• By making a booking, you consent to the use of your personal data in accordance with our Privacy Policy, which explains how we collect, store, and protect your information
• You are responsible for ensuring that all information you provide to us is accurate and up to date
15. GOVERNING LAW & JURISDICTION
• These Terms and any disputes arising from your booking or stay shall be governed by and construed in accordance with the laws of Thailand
• Any dispute shall be submitted to the competent courts of Thailand, without prejudice to any mandatory protective provisions that may apply to you under consumer law
